Construction parking and right-of-way permits.

The short answer

In the Town of Palm Beach, every worker's vehicle parks on the construction site from permit issuance to the certificate of occupancy. If the site can't hold them, the contractor carpools or applies for up to three right-of-way parking permits, and any work in the road needs its own right-of-way permit, filed at least 72 hours ahead.

Parking on the construction site

All vehicles of workers or visitors park on the construction site, from permit issuance to certificate of occupancy. If the site can’t hold them, the contractor carpools or applies for up to three right-of-way parking permits.12

On Worth Avenue, right-of-way parking permits are limited to two vehicles, and only for loading, unloading and essential construction activity.1

Right-of-way permits

Any work in the road right-of-way (the roadway, the sidewalk or the shoulder) needs a right-of-way permit. That includes deliveries, concrete pours, dewatering, sewer work and cranes. File the correct application at least 72 hours before the work.2

The Town’s application lists these permit types:3

  • Construction parking
  • Use of or work in the right-of-way: trucks, cranes, loaders
  • De-watering
  • Driveway
  • Excavation in the right-of-way
  • Water or sewer service
  • A 2-hour delivery permit: hand unloading only, no equipment
  • Private lateral locates

Work in a road right-of-way may not begin before 9:00 a.m. unless the permit says otherwise.4 The Town also notes that vehicles longer than 30 feet may have difficulty on Town roads, and large truck deliveries carry higher permit fees.3

Right-of-way work in season

A right-of-way request for the season, November 1 through April 30, has to explain why the work must happen in season. It also proposes a 2-hour working window between 10:00 a.m. and 2:00 p.m.3

Fees and penalties

Since November 1, 2025, every right-of-way submittal is invoiced a non-refundable $25 application fee.3

The 3-Strike Rule

Before a building permit is issued, the owner signs a notarized acknowledgment of the 3-Strike Rule.1

    1. Each documented parking, site-management, noise or construction-hours violation is a strike. Appeals are filed in writing within seven days of the ticket.25
    2. After any adjudicated strike, code violation or stop work order, the owner and contractor sign a Construction Management Agreement with the Town: hours, routes, shuttles or carpooling, parking and neighbor notice.5
    3. Three strikes at one site bring a Stop Work Order, and only the Town Council can restart the job.25

Dumpsters, toilets and debris

Dumpsters, construction materials and portable toilets sit inside the construction barrier, and the gates close at night and on weekends. Barriers visible from the street are 6 to 12 feet tall and one color, green or black.6

A jobsite portable toilet permit is $100 each.2 From permit to completion, the builder keeps the whole site clean of debris, on both sides of the street, except material in approved containers.7
